TERMS AND CONDITIONS

Please read these terms and conditions carefully as you are bound by these when you book and stay at Indulge Luxury Homes properties.

 

Reservation

To book one of Indulge Luxury Homes properties, you may call us on 1300 539 559, book online through our website www.indulgeapartments.com.au or email us on info@indulgeapartments.com.au with your contact details and a member from reservations will contact you to confirm your reservation. A valid driver’s licence is to be provided for all bookings.
Indulge Homes reservations require a valid credit card on file at time of booking, if no credit card is available your reservation cannot be accepted. Full payment is processed two weeks prior to arrival, unless the booking is for a peak period and in this instance full payment will be processed on booking.
Excluding Peak Period reservations, full payment is processed two weeks prior to arrival and booking is Non-refundable, a refund of the cleaning fee only will be issued for cancelled bookings inside of 14 days prior to arrival. All Peak Period bookings are non-refundable and total payment will be processed at time of booking.
$130 cleaning surcharge applies to all Indulge Homes 77 Olive Ave bookings.
$150 cleaning surcharge applies to all Indulge Luxury Homes Dockside Marina bookings.
$165 cleaning surcharge applies to all Indulge Luxury Homes Marina 4 bookings.
$75 City View Penthouse (Two Bedroom Penthouse)
$85 City View Penthouse (Three Bedroom Penthouse)
(For stays of more than 7 nights, cleaning surcharges apply weekly).

A copy of guests Driver’s Licence will be requested prior to self-check in access instructions being provided.
Any booking amendments for date changes and apartment/property moves are subject to a $5.50 amendment fee per amendment, this fee is non-refundable.
Should there be a temporary outage from an outside supplier of utilities’, such as power, gas, water, internet etc…No compensation is available to guests, as it is out of our business control.

 

Guest Behaviour

Indulge Apartments and Homes has zero tolerance for aggressive or abusive behaviour. Offending guests will have their bookings cancelled and will be blacklisted and refused any future bookings.

 

Payments

The person/s or entities registered as or on behalf of the guest/s agree to pay in full all tariffs, surcharges and other charges incurred during the stay at Indulge Luxury Homes.
All rates are quoted in Australian dollars.
Payments can be made via online bank transfer*, cash, EFTPOS, or via credit card. Major credit cards are accepted including; Mastercard, Visa and American Express.
*Note payments via overseas Online Bank Transfer will incur a $10 fee.
*Note payments via credit card will incur a 1.5% fee for Visa and MasterCard and 2% for AMEX.
Invoices will only be issued if pre-arranged and approved by management.

 

Bond Conditions

The registered guest for all Indulge Apartments and Homes must provide a valid credit card upon making a reservation, which will be kept on file for security/bond purposes. Indulge Apartments and Homes reserves the right to process an authorisation on the credit card on file to be held as a bond to cover any incidental charges. All bookings for Friday and Saturday nights, New Year’s Eve or other peak period dates will have a $300 for Apartments ($1000 local and Broken Hill guests) and $500-$1000 for Homes and Penthouse bookings ($2000 for local and Broken Hill guests) bond authorisation on credit card provided by registered guest (for bookings 4 days or more or for local and Broken Hill guests the bond will be processed as a sale and will incur a credit card surcharge (non-refundable surcharge for American Express cards) and the balance refunded as per the below terms). If funds are not available for bond authorisation, self-check in access instructions for accommodation will not be provided. Bond authorisations are processed two days prior to arrival, or when booked within two days of arrival, it will be processed on booking.
Upon departure and the return of all keys, the apartment will be inspected. If…

  • Any item is stolen or removed from the premises
  • There is any damage caused to Indulge Apartments property, by the guest or anyone invited onto the property by the guest. This includes all items and structures inside the apartment and all external and communal areas on the Indulge Apartments properties.
  • The guest breaches the above ‘No Parties’ policy and refuses to leave the premises
  • The guest breaches any of the listed Terms and Conditions

The registered guest will automatically lose their bond and additional charges may be added if the total cost exceeds the bond amount and will be processed on the on the credit card on file, if the payment is declined the guest will be contacted and must provide an alternative credit card number so that payment can be processed on day of departure or otherwise authorised by Indulge Apartments Management, if this is not provided, the matter will be referred to Police and charges will be laid. The charges will also incur a $50 administration fee.

Indulge Apartments and Homes reserves the right to process a pre-authorisation on the credit card on file to be held as a bond to cover any incidental charges.
Note: Our bank releases the authorised funds the day the pre-authorisation is cancelled, however the guests own bank can hold their funds for up to six days, this is out of our control and the guest is encouraged to follow up with their bank.

 

Cancellation Policy

Cancellations for Indulge Homes properties will be accepted up to 2 weeks prior to arrival date (except during peak periods), a $5.50 cancellation fee applies for bookings cancelled outside of 14 days of arrival. Full payment is processed two weeks prior to arrival and booking is Non-refundable, a refund of the cleaning fee only will be issued for cancelled bookings inside of 14 days prior to arrival. In the event of a reservation cancellation being made after check-in or for no-shows, there is no refund available, including the cleaning fee. There is no refund for cancellations made for Peak Period reservations and full payment is processed on booking.
Peak Periods for Indulge Homes include:

  • Long weekends
  • Victorian Public holidays
  • December 15 to January 15 (Christmas/New Year period)
  • Easter Weekend
  • Hattah Desert Race
  • All Major Mildura Events (E.g: Country Music Festival, Vanilla Slice Competition, Mildura Jazz Food & Wine Festival etc)

N.B: Please note these events are subject to change without notice.

 

Check-in/out

Indulge Luxury Homes offer self-service express check in and check out. Each home has a key safe located at the property; this will contain the keys to the property. Two days prior to your arrival, once your bond has been processed and government issued phote identification is on file, the access instructions, including: location details, car parking instructions, and access codes to your key safe and buildings (where applicable) will be emailed through to you.
If you would prefer to have a personal welcome, please arrange this at time of making reservation.
Check-in can occur 24 hours a day, 7 days a week, within the allocated times. Check is from 3pm daily and check out is at 10am.
A late departure fee will be charged to the guest if they do not adhere to the check-out time as the housekeeping staff will be delayed.

 

Car Parking

Car parking details will be provided in your Indulge Luxury Homes access instructions and can be confirmed on making reservation.
Management advises that guests park their vehicles at their own risk.

 

Damage & Theft

You are responsible for leaving the property in the state in which you found it on arrival.
Guest/s shall be liable for any loss, theft or damage to keys, furniture, fixtures and all fittings in the home/s and associated common areas and loss of business resulting from this damage or theft. Fair wear and tear excluded. Indulge Apartments and Homes has the right to choose preferred businesses for prompt repairs or replacements of guests’ damage or loss.
Indulge Luxury Homes shall not be responsible for, or liable to compensate for, the loss, theft or damage and loss of business to any property whatsoever brought onto the premises.
The guest will be liable for repair or replacement costs and loss of business if:
Any item is stolen or removed from the premises
There is any damage caused to Indulge Luxury Homes property, by the guest or anyone invited onto the property by the guest. This includes all items and structures inside the home and all external and communal areas on the Indulge Luxury Homes properties, whether intentional or accidental.
The guest breaches the ‘No Parties’ policy and refuses to leave the premises
Other incidental charges (as described below)
It is our policy to have all locks changed if keys are lost or not returned. All associated costs will be charged to the credit card provided for payment (or left for security) if this occurs. Similarly, any remote controls will be replaced at your cost if lost or not returned.
And will be charged to the credit card on file for the registered guest all of which are due and payable on day of departure, or as advised by Indulge Luxury Homes management. The charges will also incur a 3.5% administration fee.

 

Incidental charges

Extra charges including telephone usage, valet dry cleaning, restaurant charge backs, loss of keys, and any breakages, theft or damage will be charged to your valid credit card or deducted from your bond or if total is greater than your bond amount you will be invoiced for balance owing (see above for Bond conditions) at the end of your stay- (minimum charge to credit card – $10.00).
In the event you lock yourself out of the home, a call out fee will be charged to unlock the home when the keys have been locked inside. This will be charged on the credit card provided for payment (or left for security).
Guests are expected to leave the properties in a neat and tidy state without the need for extensive, excessive cleaning. You are responsible for all cleaning charges in the event that the property is left in a state that requires more than standard cleaning. This will be charged for using the credit card provided for payment (or left for security). A minimum of $100 will be charged in this event. All bookings will incur a $165 cleaning surcharge in Indulge Luxury Homes – Marina 4 and $150 cleaning surcharge for all bookings in Indulge Luxury Homes- Dockside Marina and $130 for bookings Indulge Homes – 77 Olive.
The removal of consumable items from the property which are provided for guest use whilst in-house and are not intended as individual use presentations (examples include laundry powder, dishwashing liquid, toilet paper and tissues etc) will be charged on the credit card provided for payment (or left as security).
For all guests’ convenience, Indulge Luxury Homes has a strict non-smoking policy. A minimum penalty fee of $500 applies to those not observing this policy (as detailed under “No Smoking Policy”) and more if the property is not able to be sold post check out due to the smell.
Please note for all restaurant charge backs, pantry packs, newspaper delivery and valet dry cleaning, a 3.5% surcharge.

 

No Smoking Policy

Indulge Luxury Homes actively enforce a strict No Smoking Policy inside all properties; this is for all guests’ comfort and enjoyment of the properties. For the convenience of smokers outside areas may be used and ash trays are provided. A penalty fee of a minimum of $500 applies to those not observing this policy and will be processed on the valid credit card on file or deducted from the bond and more if the property is not able to be sold post check out due to the smell.

 

No Party and Excessive Noise Policy

Indulge Luxury Homes actively enforce a No Party and Excessive Noise Policy. No parties of any kind are permitted on any premises. Any person(s) whether they be the registered guest or a visitor(s) found to be creating excessive noise, having a party in the home, or exceeding the maximum number of permitted guests will be evicted without refund. Any subsequent damage will be charged to the registered guest. Complaints resulting in security being called to warn of noise complaints will be charged to the guest making the disturbance.
The number of guests in the home/s at any one time shall not exceed the number of guests declared when booking. Should at any time the number of guests in the room/s exceed the number declared, Indulge Luxury Homes reserves the right to either charge extra according to the additional number of guests or alternatively terminate the reservation immediately, without a refund.
All guests are expected to behave in a manner that does not cause distress to neighbours or interfere in any way with their right to enjoy their properties. We reserve the right to remove guests who do not adhere to this code of behaviour. In these cases, no refund will be due, and we will not be responsible for finding or funding alternate accommodation, nor will we be responsible for any other associated costs.
Guests may not engage in any illegal activity at any Indulge Luxury Homes properties.

 

Barbeque

The Barbeque is provided for guests’ enjoyment. A procedure for safe use of the Barbeque and gas is displayed beside the Barbeque, this must be followed strictly by the guests and any visitors to the property. On departure, the guest must leave the Barbeque in a clean and usable condition for the next guest, failure to do so will incur a mandatory $70 cleaning surcharge.

 

Personal Belongings

Management reserves the right to accept NO RESPONSIBILITY for any damaged items and or payments for any items left on premise after guest departure. No responsibility can be accepted for personal goods left behind on departure.
Lost property will be held for no longer than Thirty days. At the end of the Thirty days all lost property will be donated to a charity of choice by Indulge Luxury Homes.
All items will be held in off premise storage and will be available for collection with prior notification, however we will not be held responsible for items uncollected. It is the guest’s responsibility to ensure that all items are collected when pre-arranged.
Indulge Luxury Homes will gladly arrange return of these items upon request. Indulge Luxury Homes uses Australia Post Express Post Mail to have items returned to a supplied address. Indulge Luxury Homes will not be held accountable for any costs incurred for return of these items and an additional $10 handling charge will also be applied.

 

Recycling and Garbage

Garbage must be disposed of in the allocated bins in the home, if there is excess rubbish, please dispose of in council bins provided, rubbish must not be left in public or common areas. In the event, non-recyclable items are placed in the recyclable bins, the registered guest will be charged a $100 fee for housekeeping to sort through and separate rubbish so that our local council can collect and dispose of rubbish.
Bedding
For the Marina 4 and Olive Avenue home where some king beds can be split into two single beds, a fee applies per bed and must be organised at least 24 hours prior to arrival. Beds cannot be split on the day of arrival.
Termination
Your occupation of the property may be terminated by Indulge Luxury Homes without notice in the event that you breach any material term or condition or in the event that any amount due is not paid.

To use our website, you must be 18 years or older and must have legal authority to enter the agreement.
We make no representations about the accuracy or suitability of the information provided on our website. The information is provided ‘as is’ without express or implied warranty. You use the information and website at your own risk.
In no event shall Indulge Luxury Homes be liable for any special, indirect or consequential damages or any damages whatsoever resulting from loss of use, data or profits, whether in an action contract, negligence or tort, rising out of or in connection with the use or performance of materials on this service.
Indulge Luxury Homes reserves the right to relocate a booking to an alternative property of similar standard and location at any time. In this instance, guests will be offered either a full refund OR asked to confirm their stay at the alternative property.
By making a reservation, you agree to all the Indulge Luxury Homes terms and conditions.
Indulge Luxury Homes reserves the right to modify or change the terms and conditions at any time without prior notice to you. Your reservation constitutes an acceptance of any such modification and we advise you to refer to these terms and conditions regularly.
